Terms of Service

These terms are an agreement between you and BillSend. They cover the BillSend iPhone app, the invoice, estimate and payment pages it creates for your clients, and this website (together, "BillSend"). By creating an account or using BillSend, you agree to them. If you use BillSend for a business, you agree on behalf of that business.

Getting paid by your clients

Online payments on BillSend invoices are processed by Stripe. To accept them, you need a Stripe account, and you agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. BillSend is not a bank or money transmitter, and does not hold your funds.

Your content and your clients

Don't use BillSend to:

We may suspend or close accounts that break these rules, and we may tell Stripe or the authorities when the law requires it.

BillSend itself

BillSend, its design, software and branding belong to us and our licensors. These terms give you a personal, non-transferable right to use BillSend while your account is in good standing. We keep improving BillSend, so features may change, and we may stop offering some of them. If we make a change that substantially reduces what your paid plan includes, we'll tell you in advance.

Our Privacy Policy explains what information BillSend collects and how it's used.

Disclaimers

BillSend helps you make documents and collect payments, but it is not tax, legal or accounting advice. Check totals, tax rates and terms before you send them. BillSend is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we don't promise BillSend will be uninterrupted or error-free.

Limitation of liability

To the extent the law allows, BillSend is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claim about BillSend is limited to the greater of the amount you paid us in the 12 months before the claim, or $100. Some places don't allow these limits, so they may not all apply to you.

Indemnity

If someone brings a claim against us because of your content, your dealings with your clients, or your breach of these terms or the law, you agree to cover our reasonable costs and losses from that claim.

Ending your account

You can stop using BillSend and delete your account at any time from the app. Cancel your App Store subscription separately in iOS Settings. We may suspend or end your access if you break these terms, or if we need to for legal reasons. The sections on payments you owe, your content, disclaimers, liability and indemnity continue after your account ends.

Apple

These terms are between you and BillSend, not Apple. Apple is not responsible for BillSend or its content, and has no obligation to provide maintenance or support for it. If BillSend fails to meet a warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for BillSend. Apple is not responsible for claims about BillSend, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not in a country subject to a US government embargo, and are not on a US government list of prohibited or restricted parties.

Changes to these terms

If we change these terms, we'll update the date above, and tell you in the app if the change is significant. If you keep using BillSend after a change takes effect, the new terms apply.
